If you do Publish information, comments or other content on or to the website, or any information, image, videos or any data whatsoever collected during any public event conducted by My Children Foundation or an interview with any users, and unless we indicate otherwise, you grant us a nonexclusive, royalty-free, perpetual, irrevocable and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate these General Terms and Conditions.

User owns all of the content and information posted by User on website.  For content and information that is covered by intellectual property rights (“IP Content”), User specifically grants My Children Foundation a perpetual, non-exclusive, irrevocable, transferable, sub-licensable, royalty-free, worldwide license to use any IP Content that is posted, uploaded or otherwise stored through User’s use of the features on website.

Mobile Services: Certain services that are available via a mobile device, including (i) the ability to upload content to the Services via a mobile device, (ii) the ability to browse the Services and the Site from a mobile device. To the extent you access the Services through a mobile device, your wireless service carrier’s standard charges, data rates and other fees may apply. In addition, downloading, installing, or using certain Mobile Services may be prohibited or restricted by your carrier, and not all Mobile Services may work with all carriers or devices. By using the Mobile Services, you agree that we may communicate with you regarding My Children Foundation and other entities by SMS, MMS, text message or other electronic means to your mobile device and that certain information about your usage of the Mobile Services may be communicated to us. In the event you change or deactivate your mobile telephone number, you agree to promptly update your My Children Foundation account information to ensure that your messages are not sent to the person that acquires your old number.

Social networking services: You may enable or log into the Services via various online third party services, such as social media and social networking services like Facebook or Twitter (“Social Networking Services”). By logging in or directly integrating these Social Networking Services into the Services, we make your online experience richer and more personalised. To take advantage of this feature and capabilities, we may ask you to authenticate, register for or log into Social Networking Services on the websites of their respective providers. As part of such integration, the Social Networking Services will provide us with access to certain information that you have provided to such Social Networking Services, and we will use, store and disclose such information in accordance with our Privacy Policy. For more information about the implications of activating these Social Networking Services and My Children Foundation’s use, storage and disclosure of information related to you and your use of such services within My Children Foundation (including your friend lists and the like), please see our Privacy Policy. However, please remember that the manner in which Social Networking Services use, store and disclose your information is governed solely by the policies of such third parties, and My Children Foundation shall have no liability or responsibility for the privacy practices or other actions of any third party site or service that may be enabled within the Services.

In addition, My Children Foundation is not responsible for the accuracy, availability or reliability of any information, content, goods, data, opinions, advice or statements made available in connection with Social Networking Services. As such, My Children Foundation is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Social Networking Services. My Children Foundation enables these features merely as a convenience and the integration or inclusion of such features does not imply an endorsement or recommendation.

Donations: In order to contribute to cause of My Children Foundation, you, as a Donor, represent and warrant to My Children Foundation that all information, including information related to credit cards or other payment instrument, you provide to My Children Foundation is true. You are authorized to use the payment instrument. You agree that a certain minimum Donation amount may apply, and subject to the refund policy, that all Donation payments are final and cannot be refunded. Donors may have the option to contribute recurring period donations, and in electing to contribute on a recurring basis, you, as a Donor, (i) agree to promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur and to pay the Donation amount that you specify, and (ii) hereby authorize My Children Foundation to bill your payment instrument in advance on a periodic basis until you terminate such periodic payments through the Platform.

User acknowledges and agrees that My Children Foundation did not provide any goods or services to User personally in consideration for any donations made by User as part of a Transaction. My Children Foundation will apply User’s donations in accordance with its internal policies and procedures.

You, as a donor, also understand that a portion of your donation will be utilized for the legal, operational & infrastructure cost of running the organization and only the rest amount will be used towards the beneficiaries.

Anti-Money Laundering (AML) policy: We comply with the Anti-Money Laundering (AML) guidelines established by the Reserve Bank of India. The guidelines include, but is not limited to, the following salient conditions:

  1. Any user who may get involved in financial transactions has to verify their identity per the Know Your Customer (KYC) in the guidelines. This includes verification of registered mobile number via a One Time Password (OTP), and may also include one of the identification documents viz. Permanent Account Number, Aadhar Card, Passport, Driving License, Voter Id . recognised by the Reserve Bank of India. The list of such registered documents will be updated on My Children Foundation site, at its sole discretion, from time to time.
  2. For contributors on www.my-children.org, only standard channels of payment– verified credit or debit cards, netbanking, bank transfers, cheque, prepaid instruments such as wallets, Unified Payment Interface or cash (upto limits allowed by the RBI) – will be allowed. In case of cash payments, all payments above INR 24,999 have to be furnished with the Permanent Account Number of the contributor. Cash payments are accepted for Indian residents only.

Refund policy: Donations made through My Children Foundation are final and cannot be refunded, except in accordance with My Children Foundation’s Refund Policy. All Donation payments are final and cannot be refunded. However, My Children Foundation will issue refunds for the following “exceptional” scenarios.

  • A Donation has been identified to have been initiated using an unauthorised payment instrument not belonging to the user by the user (Donor) and the user wishes a refund

Any other claims for refunds shall be honoured at the discretion of My Children Foundation Team.

The timely refund of the donation will depend upon the type of credit card/banking instrument used during the transaction. The donor will have to send us a written request for a refund within 2 days of making the donation along with-

  • Proof of the deduction of the donation amount.
  • In cases where the donation receipt has already been issued to the donor, the donor will have to return the original receipt to us at our communication address mentioned in our website.
  • If the tax exemption certificate is already issued, then we are sorry but we will not be able to refund the donation.

If the donor doesn’t write within two days, then refund is not possible.

Copyright Complaints: My Children Foundation respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify My Children Foundation of your infringement claim in accordance with the procedure set forth below.

My Children Foundation will process and investigate notices of alleged infringement and will take appropriate actions under the applicable intellectual property laws with respect to any alleged or actual infringement. A notification of claimed copyright infringement should be emailed to info@my-children.org.

To be effective, the notification must be in writing and contain the following information:

  • an electronic or physical signature of the person authorised to act on behalf of the owner of the copyright or other intellectual property interest;
  • a description of the copyrighted work or other intellectual property that you claim has been infringed;
  • a description of where the material that you claim is infringing is located, with enough detail that we may find it;
  • your address, telephone number, and email address;
  • a statement by you that you have a good faith belief that the disputed use is not authorised by the copyright or intellectual property owner, its agent, or the law;
  • a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorised to act on the copyright or intellectual property owner’s behalf.

Counter-Notice: If you believe that your User Content that was removed (or to which access was disabled) is not infringing, or that you have the authorisation from the copyright owner, the copyright owner’s agent, or pursuant to the law, to upload and use the content in your User Content, you may send a written counter-notice containing the following information to us:

  • your physical or electronic signature;
  • identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
  • a statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
  • your name, address, telephone number, and email address,

If a counter-notice is received, My Children Foundation will send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.

Repeat Infringer Policy: In accordance with the DMCA and other applicable law, My Children Foundation has adopted a policy of terminating, in appropriate circumstances and at My Children Foundation’s sole discretion, users who are deemed to be repeat infringers. My Children Foundation may also at its sole discretion limit access to the Services and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Account Holders or Registered Users:

Time to time we may create different user roles and provide provision to register with us. Currently, there are roles of child, volunteer, member, change agent, donor & mentor. Users can register themselves with any of these roles and create an account with us. For those registered users, following terms & conditions apply wherever applicable in addition to terms & conditions mentioned in this document elsewhere.

Registration or application for any role does not guarantee confirmed membership or any service entitlement whatsoever. My Children Foundation will verify, validate and then confirm membership. It is at My Children Foundation’s discretion to decide when and how a member will avail the actual service. The decision is primarily made based on availability of willing parties, availability of capacity of My Children Foundation and other critical parameters under consideration of My Children Foundation. Any registered member can opt out from this service by informing My Children Foundation over any medium mentioned in our Contact Us page or at the end of this Terms & Conditions. My Children Foundation may also stop any service to any member any time because of multiple factors, not limited to, capacity of My Children Foundation, irregularities or non-compliance to prevailing government laws or My Children Foundation’s terms & conditions or new priorities of My Children Foundation. In case of any such irregularities or non-compliance, My Children Foundation may take appropriate legal actions against any such violators.

Any interactions among any registered users without knowledge of My Children Foundation will not be subjected to any responsibility or obligation from My Children Foundation. All consequences will be owned and accounted by parties involved.

We may collect mandatory contribution for some roles to fulfill the vision and mission of the trust and run the organization smoothly. Currently, we collect token contribution of INR 500 or USD 10 monthly from all the users with role “Member”.

My Children Foundation is a platform to connect people and facilitate social changes through helping each other. User provides all the information willingly and My Children Foundation may use this information to realize the vision and mission of this foundation. Any interactions between any users beyond knowledge of My Children Foundation or outside of the scope of our service will be treated as personal and My Children Foundation will not be held responsible for any damage or consequences thereafter. The responsibilities will belong to the individual parties or the legal custodian of the party in case of minor.

Any child is responsibility of legal custodian and My Children Foundation is providing all support or help in concurrence with the legal custodian without any obligation. My Children Foundation will not be responsible or held accountable for any consequences on the child which are without direct involvement of My Children Foundation or unknown to it.

User is at least eighteen (18) years old, or, if younger than eighteen (18) years old, User is of an age sufficient to execute a legally enforceable agreement on his or her own behalf in the applicable jurisdiction. In case of registering a child, applicant submits the information on the child and manage the account after taking due permission from the legal custodian of the child, if any.

All the information, data and other materials provided by User in support of User’s application for registration are accurate and truthful in all respects;

While registering a child with My Children Foundation, it is mandatory to furnish all the details of other supports or help the child or its immediate family or family members receive in terms of, but not limited to grants, scholarships, donations, facilities, materials, financial help provided by government or any other organizations or individuals. This is an ongoing check and needs to be periodically reviewed and updated.

User is the rightful owner of any account opened his or her name, included but not limited to Payment Accounts, and is authorized to commit funds from the relevant accounts to My Children Foundation for purposes of conducting Transactions.

You are responsible for maintaining the confidentiality of your password and account, if any, and are fully responsible for any and all activities that occur under your password or account. You agree to (a) immediately notify My Children Foundation of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you sign out from your account at the end of each session when accessing the Services. My Children Foundation will not be liable for any loss or damage arising from your failure to comply with this Section.

My Children Foundation may terminate User’s registration, in whole or in part, as follows:

For Cause. Immediately (1) in order to comply with applicable Law or instructions from any governmental agency or authority; (2) if My Children Foundation, in its sole discretion, suspects that User is using the sites in a manner not permitted by these the Terms and Conditions; or (3) upon any breach of these Terms and Conditions, the My Children Foundation Website General Terms and Conditions or the My Children Foundation Privacy Policy by User.

For convenience, upon Notice by My Children Foundation to User, which may occur after an unsuccessful login attempt by User.

Upon the expiration or earlier termination of User’s registration, for any reason (i) user will no longer be authorized to access the his account or otherwise use any of the features or services; (ii) My Children Foundation may delete any data associated with User’s accounts, including but not limited to, any content in User’s Account; and (iii) all rights and obligations of the Parties under these Terms and Conditions shall expire.

HOWEVER, PLEASE UNDERSTAND THAT SOME PORTION OF THAT FUND WILL BE USED TO RUN THE ORGANIZATION AND 100% WILL NOT BE USED DIRECTLY FOR THE BENEFICIARIES.

Limitation of Liability

Indemnification

You will indemnify and hold harmless My Children Foundation, its affiliates and their respective current, future or former trustees, officers, directors, partners, employees, agents, contractors, licensors, suppliers and their successors or assigns (collectively, the “My Children Foundation Group”) on demand, from and against any and all fines, penalties, liabilities, losses and other damages of any kind whatsoever (including attorneys’ and experts’ fees) incurred by any of the members of the My Children Foundation Group, and, if directed by My Children Foundation, shall defend the My Children Foundation Group against (i) all claims that any information, data or other materials provided or Published by you in connection with the website or these General Terms and Conditions, or use thereof by any member of the My Children Foundation Group, infringes, misappropriates or otherwise violates any patent, trademark, copyright, trade secret or other intellectual property, proprietary or privacy right of a third party, or that violates any law, rule or regulation; (ii) all claims arising from fraud, intentional misconduct, criminal acts or gross negligence by you; and (iii) all claims otherwise arising due to a failure by you to comply with any term or condition of these General Terms and Conditions.

Termination of Privileges

Force Majeure

My Children Foundation will be excused from performance under these Terms and Conditions for any period that it is prevented from or delayed in performing any obligations pursuant to these Terms and Conditions, in whole or in part, as a result of a Force Majeure Event. For purposes of this Section , “Force Majeure Event” means an event or series of events caused by or resulting from any of the following: (1) weather conditions or other elements of nature or acts of God; (2) acts of war, terrorism, insurrection, riot, civil disorder or rebellion; (3) quarantines or embargoes; (4) labour strikes; (5) telecommunications, network, computer, server or Internet downtime; (6) unauthorized access to My Children Foundation’s information technology systems by third parties; or (7) other causes beyond the reasonable control of My Children Foundation.

My Children Foundation reserves the right to make changes to these General Terms and Conditions at any time by posting revised General Terms and Conditions on the website. It is your responsibility to check periodically for any changes we may make to these General Terms and Conditions. Jurisdiction

This website is controlled and operated by My Children Foundation from its office in Kolkata, West Bengal state, India. The laws of West Bengal State govern these General Terms and Conditions and your use of the website. We recognize that it is possible for you to obtain access to this website from any jurisdiction in the world, but we have no practical ability to prevent such access. This website has been designed to comply with the laws of West Bengal State, and India. Those who choose to access the website from other locations do so on their own initiative and are responsible for compliance with local laws if and to the extent local laws are applicable. If any material on this website, or your use of the website, is contrary to the laws of the place where you are when you access it, then the website is not intended for you and we ask you not to use the website. You may not use or export materials on this website in violation of Indian laws and regulations. This website is not intended to subject My Children Foundation to the laws or jurisdiction of any state, or territory other than the West Bengal & India.

If a dispute arises under these General Terms and conditions between you and My Children Foundation, such dispute shall be resolved in (i) West Bengal, India; and (ii) at the filing party’s election, in either a small claims court or by final and binding arbitration administered by the National Arbitration Forum/Tribunal under their rules for consumer arbitrations.  All disputes in arbitration will be handled solely between the named parties and not on any representative or class basis.  ACCORDINGLY, YOU ACKNOWLEDGE THAT YOU MAY NOT HAVE ACCESS TO A COURT (OTHER THAN A SMALL CLAIMS COURT) OR JURY. Notwithstanding any other provision of these General Terms and Conditions, My Children Foundation may resort to court action for injunctive relief at any time if, in its good faith, the dispute resolution procedures described above would permit or cause irreparable injury to  My Children Foundation or any third party claiming against a My Children Foundation, due to delay arising out of such dispute resolution procedures.

Miscellaneous

If any provision of this agreement is unlawful, void or unenforceable, the remaining provisions of the agreement will remain in place. These General Terms and Conditions constitute the entire agreement and understanding between you and My Children Foundation with respect to use of the website, superseding all prior or contemporaneous communications. A printed version of these General Terms and Conditions shall be admissible in judicial or administrative proceedings based on or relating to use of the website to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
